FSSAI Notification Regarding Ease Of Doing Business: Instant Renewal Of License/ Registration

  1. FSSAI Licenses and Registrations were granted for a period of 1 to 5 years subject to the selection and payment done by the Food Business Operators (FBOs) in the application. After that, FBOs were prescribed to renew their license or registration by submitting the application together with the required documents in accordance with the FSSAI’s notification dated 19 March 2021. The renewal application was examined by the appropriate Licensing and Registering Authority for the granting of a renewed License/Registration. This analysis and inspection take substantial time and effort with an increase in the number of licensed or registered FBOs each year. 
  2. In view of the foregoing and to streamline the procedure of registration/licensing and its renewal process, FSSAI, through its order of 11th January 2023, has made to:
  3. a)       Renewal of the license or registration following the submission of an application to the FBO is granted instantly and without the need to be approved or scrutinized by the relevant authority, but such renewal is subject to certain conditions:
  4. i)       No Change: No modification in the current details of the license or registration shall be approved.
  5. ii)       Validity: Validity Renewal –
  •       For License – The license renewal shall be limited to 1 year only.
  •       For Registration – The registration renewal shall be renewed as per the existing provision, i.e., for 1 to 5 years, depending on the selection and payment done by the FBO in the application.

iii)     Suspension / Cancellation: Food Business Operators whose license or registration has been suspended or canceled shall not be permitted to license / registration renewal.

  1. iv)     Filing Annual Return by FBOs: Additionally, w.e.f. 10th November 2022, the FoSCoS system guarantees the FBOs (manufacturers and importers) shall file annual returns with any penalties (if there is any) prior to renewal for the financial year 2021-2022 onwards.
  2. v)       Declaration: A statement to be submitted by FBO (tick in the check box) has been included to FoSCoS as follows:
  •       I/We have complied with all the permissions/rules which are applicable to my food business and the premises of the food business, such as CGWA NOC etc.
  •       I/We do not possess more than one active license/ registration for any other food business(es) at the same premises;
  1. b)     Validity Of The New License / Registration
  2. i)       For License: The validity of the new license is now limited to only 1 year instead of the current provision, i.e.,

“Clause 2.1.7 of the FSS (Licensing and Registration of Food Businesses) Regulation states that Registration or license granted shall be valid for a period of 1-5 years, as chosen by FBO, from the date of issue of the registration/license.”

  1. ii)       For Registration: The validity of food registration remains as per the existing provision, i.e. for 1 to 5 years, depending on the selection and payment received by the FBO.
  2. c)       The grant of registration / license renewal is instant and is not subject to the scrutiny of the licensing and registration authorities; there will be no late fee of the amount of Rs. 100 per day levied (earlier applicable in the case of the license under clause 2.1.7 in the FSS (Licensing and Registration of Food Business) Regulation) if the renewal application is filed within the thirty days preceding the expiry.
  3. However, the penalties imposed to renew expired registrations or licenses for up to 180 days following the expiry date will remain in effect. For FBOs, it is recommended to submit renewal applications at the earliest opportunity before the expiry date to avoid the rush at the last minute and the resulting cost (due to the expiration date) in the event of an unexpected portal or online problems during the expiry date.
  4. The declaration with respect to the FSMS plan has also been automated within FoSCoS, and FBOs are needed to self-proclaim compliance to the points on the checklist for inspection when they apply for renewal.
  5. This order will be effective for applications made on or after 12 January 2023.

 

Conclusion –

  1. Instant renewal of registrations and license subject to compliance with certain conditions.
  2. FBOs (Manufacturers and Importers) are not permitted to renew their membership unless an annual return has been submitted for F.Y. 2021-22 onwards.
  3. Reduced time to obtain a State or Central License from 1-5 years to 1 year only.
  4. Elimination of late fees of Rs. 100 per day when the renewal application is submitted within the last 30 days before the expiry date.
  5. Automated declaration of an FSMS plan.
